What Are My Rights as a Debtor?

Firstly, anyone has a right to file bankruptcy in the United States (presuming you have not previously filed within a certain time window or defrauded the system).  You have the right to choose competent counsel and also the right to file pro se. If you qualify for Chapter 7 you have the right to file under that option or a Chapter 13 repayment plan.

Once you have filed bankruptcy you are a member of a protected class and discriminatory practices against you as a result of filing bankruptcy are prohibited by law. In order to be sure that your rights are not infringed upon, it is imperative that you seek thorough, experienced counsel.
