I Already Filed Bankruptcy in Another State ... How Soon Can I File in Texas?

Contrary to popular belief how soon you can file bankruptcy is determined by how long ago you filed and what chapter, not where you filed. Whether you file bankruptcy in Nevada or Texas, federal rules apply.
If a debtor has previously filed for Chapter 7 and obtained a discharge, he must wait 8 years before filing another Chapter 7 or 6 years before filing Chapter 13, irrespective of what state it is filed in. If a debtor previously filed Chapter 13, he must wait 4 years before filing Chapter 7 and 2 before filing Chapter 13 again.
