How Many Times Can I File for Bankruptcy?

How many times one can file for bankruptcy largely depends on what type of protection the debtor is looking to file and what type of protection they filed in the past. If you previously filed a Chapter 7 bankruptcy you would need to wait eight years before filing another Chapter 7 and six years before filing for Chapter 13. If you previously filed for Chapter 13 you would need to weight two years before filing another Chapter 13 and four years before filing for Chapter 7. The clock starts from the date the discharge or order of relief is received, not from the date the bankruptcy was filed.
The goal is to only file for bankruptcy one time. However, if you find yourself in this situation the Fears | Nachawati Law Firm is available for your filing needs.
