I'm Married. Can my spouse and I each file separate bankruptcies?

Yes, a married person may file for bankruptcy alone. As one member of a married couple, you have the option of filing a separate bankruptcy petition or filing a joint petition with your spouse. You are not required to file either way and the Code does not have a particular preference. However, depending on the needs of you and your spouse it may be more beneficial to file one way over the other.
