I'm Married. Can my spouse and I each file separate bankruptcies?

Yes, a married person may file for bankruptcy alone. As one member of a married couple, you have the option of filing a separate bankruptcy petition or filing a joint petition with your spouse. You are not required to file either way and the Code does not have a particular preference. However, depending on the needs of you and your spouse it may be more beneficial to file one way over the other.

The bankruptcy attorneys at the Fears Nawatachi law firm are very experienced in various situations.  Contact our firm for a consultation today.
