When a debtor files for bankruptcy, regardless of the chapter and whether the debtor is an individual or entity, a bankruptcy trustee is assigned to that filing. The trustees are assigned randomly by the electronic filing system of the court where the bankruptcy is filed.
Bankruptcy trustees are responsible for reviewing the bankruptcy petition to ensure that it is truthful and that know red flags have been raised.
The bankruptcy trustee does not represent the creditors or the debtor; he or she represents the bankruptcy estate.
