I Am Unemployed: Can I File Chapter 13?

Many people in today's economy are unemployed or underemployed, however they do receive some money to survive.  Whether this is unemployment benefits or side gigs here and there we all need money to survive.  Is unemployment enough to file for a Chapter 13 Repayment Plan?

Probably not. Unemployment benefits are temporary in nature and have a finite end date.  Chapter 13 repayment plans are typically over a 3 to 5 year period.  A debtor would have to show supplemental income above and beyond temporary unemployment benefits in order to file for Chapter 13, instead of Chapter 7.
