Will Filing for Chapter 7 get me out of my Apartment Lease?

When a debtor files for Chapter 7 the ultimate goal is to obtain a discharge of eligible consumer debt.  This would include an apartment lease.  However, because an apartment lease is a secured item, meaning what you are paying for is a commodity in your possession, you do not have the right to stay in the apartment once the lease is discharged.  So you may or may not choose to discharge your lease, even though it is allowable.

After deciding to file for Chapter 7, there are still other decisions to be made.  The attorneys at the Fears | Nachawati Law Firm have helped scores of individuals through this trying time and they can help you as well.  Contact our firm today for a consultation.
