The Bankruptcy Code requires that a debtor list all creditors in the bankruptcy petition. A creditor is someone that you owe money too. This may include the cable company, Fannie Mae and Mom. For all intents and purposes Mom is to be treated like any other creditor and that debt needs to be listed, along with American Express.
Do not attempt to file bankruptcy on your own. The ultimate goal is a complete discharge of all eligible debt. In order to receive all the benefits afforded in a bankruptcy proceeding it is important to retain knowledgeable counsel. Contact the Fears | Nachawati Law Firm for a consultation.
