How Long do I have to live in Texas to file Bankruptcy?

The general consensus is 91 days.   According to the United States Bankruptcy Code, one must reside in the jurisdiction that they wish to file bankruptcy for the greater part of the last 180 days (28 USC ยง1408(1).  This also allows you to take advantage of the state-wide exemptions as well.

It's never too early to start planning for a smooth bankruptcy filing. If you are a new Texas resident interested in filing for Chapter 7 or 13, consult a Fears | Nachawati Law Firm attorney.
