Many people view personal bankruptcy as an a la carte exercise. They feel as if you can pick and choose which debts you want to discharge and which debts you do not. However, it does not work that way. When filing for Chapter 7 or Chapter 13, a debtor must list all of his creditors, including the original lender and any collections agencies. A debtor may choose to reaffirm a debt, however this is a separate step.
If you are considering filing for Chapter 7 or 13 but are not sure about your debt discharge options, contact a knowledgeable Fears | Nachawati Law Firm attorney today.
