Can I Convert my Chapter 7 to a Chapter 13?

Yes.  Just like you can convert a Chapter 13 to a Chapter 7, the reverse is possible.  The bankruptcy code requires that a previous conversion has not occurred in the case and that a debtor meet the guidelines set out for a Chapter 13 debtor. The debtor will be subjected to a new means test to ensure that he or she qualifies for a Chapter 13.  In some cases, the trustee may motion to convert the case because he or she feels as if your financial situation warrants a 13.

The decision to file Chapter 7 or Chapter 13 is important and specific to your personal financial goals.  The Fears | Nachawati Law Firm is experienced in various bankruptcy cases and debtor circumstances.  Contact an experienced bankruptcy attorney today.
